ExQuilla for Exchange

ExQuilla allows Thunderbird users to read messages and contacts on Microsoft Exchange Server version 2007 and later. It uses the EWS protocol and requires EWS to be enabled on your email server and domain.

ExQuilla is a paid addon and requires a paid license. Keeping ExQuilla working with future Thunderbird versions is a lot of work and ongoing.

Beonex has been contributing a lot of Open-Source software to Thunderbird since over 20 years. This paid addon allows us to pay our rent.

Thunderbird 115.3.2 broke ExQuilla due to an unnecessary API change, despite being a security release. ExQuilla 115.4 fixes the problem.

Privacy Policy for Beonex GmbH and ExQuilla

This Privacy Policy informs you how Beonex GmbH ('we') uses data about you and is a legal agreement between you and Beonex GmbH.

The very first privacy law of the world was passed in Wiesbaden, Germany, a few miles from where Beonex GmbH is situated. It is part of our cultural roots. We deeply value privacy, and we have been strong privacy proponents on many occations.

We limit the amount of data collected to the minimum possible, given the technical and organizational constraints of the world we live in. However, we need some data to provide the software and services to you.

Data we collect

We collect and store data in order to conduct an orderly business, to improve the software, and to give you a license for our software and ensure that the license term is honored. Additionally, we collect and store data that you voluntarily and explicitly give to us, e.g. by sending us an email or entering data on our website.

Payment data

On our website, we collect your name, email address and your payment information. The payment information itself, like your credit card number or bank account number, is stored by our payment processing providers. For your protection, Beonex GmbH never sees nor stores such payment information, like your credit card number or bank account number, but you enter it directly at their website (even though the credit card form appears to be part of our website for aesthetic reasons, it technically is not, but it's a so-called iframe), and we only store information that allows us to link the payment providers' records with our own records, and information like your name, email address and your country.

Web server visits

We store anonymous access logs that record visits on our website and information that software requested from servers. In such access logs, we do not store your IP address or hostname, but the time of the visit, the information requested, the software used to visit, and how you got there. These access logs are anonymous. In case of errors or attacks on our servers or on us, we reserve the right to store and use all available information that we can get, to help us correct the problem or defend.

We do not use cookies on our website. None at all.

License data

In order to grant your license, we collect your name and your email addresses configured in Thunderbird.

We may send you emails to your email addresses, to grant your license, verify your identity, for example when you request changes to your account, to inform you of changes regarding ExQuilla, or other purposes related to ExQuilla or the business.

When the license is created, we record the time, your operating system, language, and country, but not your IP address.

Errors

Many users report problems that we ourselves cannot reproduce. In order to fix these issues for our users, we are recording the errors that our users encounter, and use them to help individual users, and also analyse them to find and fix the most occurring errors.

We record the error message, additional technical data about the specific error, the code lines leading to the error, the application version, and the email address of the user encountering the error.

Third parties

Our payment providers, currently Stripe, Paypal, BS PayOne and Amazon, store your payment information and other information about you. Their respective privacy policies are linked to their name here. We may add or remove payment providers at any time.In contrast to typical industry patterns, we took care to design our website in a way that only the payment provider you chose gets information about you.
The images for the map on our website is provided by a mapping provider, currently OpenStreetMap, but it may change at any time.
If we are ordered to disclose information to help fight crime by an applicable court or government agency authorized by law to request such information, we will comply.

Data we do not collect

ExQuilla processes your emails only on your local computer. Beonex GmbH does not see, collect nor store who you communicate with, nor the contents of your communications.

We do not use Google Analytics, Facebook Like buttons, or Twitter buttons.

We do not use any cookies on our website.

We designed our subscription and authentication model so that you do not need to enter a password on our website.

Changes

While we do not use cookies at the moment, it may happen in the future that we need to, as an example. The same may be true for other aspects. If we change the data we collect about you, we will update this Privacy Policy. The governing policy is the one most current at any given time. It is published at https://www.exquilla.com/privacy.

Your rights

By European law, you have several rights regarding your data, and you can look them up using the link. These include the right to correct any factually wrong data that we have stored about you, and to know what we have stored about you. You may also withdraw your consent and request that we delete all data about you, but of course that also terminates your license to use ExQuilla.

In any such cases, please write to the Responsible mentioned below. But if you still feel that we do a terrible job, you have the right to lodge a complaint at the supervisory authority responsible for us, the Datenschutzbehörde of Hessen in Wiesbaden.

However, to ensure delivery, we request that you please send important inquries by fax, because we want to be sure to not miss your request among all the spam.

End-User License Agreement (EULA) for ExQuilla

This End-User License Agreement ("EULA") is a legal agreement between you and Beonex GmbH.

ExQuilla, also called ExQuilla for Exchange, is a Thunderbird add-on software that allows the Mozilla Thunderbird email client to connect to some Microsoft Exchange servers and receive and send emails via such servers.

This document

This EULA agreement governs your acquisition and use of ExQuilla ("Software") directly from Beonex GmbH or indirectly through a Beonex GmbH authorized reseller or distributor.

Please read this EULA agreement carefully before downloading, completing the installation process or using the ExQuilla software. It provides a license to use the ExQuilla software and contains warranty information and liability disclaimers.

This EULA agreement will also govern any trial period that you use without payment. By downloading, installing or using the ExQuilla software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement. The contract is fulfilled when you download the software.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the Software supplied by Beonex GmbH herewith, regardless of whether other software is referred to or described herein. The terms also apply to any Beonex GmbH updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.

Limitations

Beonex GmbH makes no representation that ExQuilla will work with any new Thunderbird versions. Changes in Thunderbird can break ExQuilla, and Beonex GmbH makes no promises to adapt ExQuilla in such a case.

Beonex GmbH also makes no representation that the Software is fit for or works for any specific purpose, including the purposes stated above. You have a one month free trial period, during which you can evaluate the fitness of the Software and whether it works in your circumstances, your devices, your software and your Exchange server. Please use this trial period to assess the Software for your circumstances. If you are not happy with its performance, please do not use it and do not pay for it.

No warranty is provided for the software. Notwithstanding anything to the contrary and to the maximum extent permitted by applicable law, Beonex GmbH provides the software "as-is" and disclaims and excludes all warranties and conditions, whether statutory, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement of third-party rights. Beonex GmbH makes no warranty that the software will be uninterrupted, free of viruses or other harmful code, timely, secure, or error-free. Beonex GmbH does accept responsibility for willful or gross misconduct on its own part.

License Grant

Beonex GmbH hereby grants you a personal, non-transferable, non-exclusive licence to use the ExQuilla software on your devices in accordance with the terms of this EULA agreement.

You have a one-time, one month trial period, during which you can use the software at no cost to you. After that, you need to purchase a software license. The license typically lasts for one year or one month, and will be billed automatically for every term.

You are permitted to load the ExQuilla software under your control, for example on your PC or laptop. You are responsible for ensuring your device and your server meet the minimum requirements of the ExQuilla software.

Intellectual Property and Ownership

Beonex GmbH shall at all times retain ownership of the Software as originally downloaded by you, all subsequent downloads of the Software by you, and all modifications and derivates. The Software (and the copyright, the trademark, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto and derivates made based on it) are and shall remain the property of Beonex GmbH.

You are not permitted to:

Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
Use or inspect the Software or the source code of the Software to help you create a replacement of the Software and distribute this replacement to others, effectively forming a competition, whether you have commercial interests or not
Reproduce, copy, distribute, resell or otherwise make the Software available to third parties
Allow any third party to use the Software on behalf of or for the benefit of any third party
Use the Software in any way which breaches any applicable local, national or international law, nor in the military or military contractors
Use the Software for any purpose or in any way that Beonex GmbH considers is a breach of this EULA agreement

Should you violate any of the above provisions after "You are not permitted to", in addition to penalties and other damages, you agree to reimburse Beonex GmbH for the financial damage or loss of income that likely resulted from your actions, based on a reasonable estimate made by Beonex GmbH.

Beonex GmbH reserves the right to grant licences to use the Software to third parties.

If you contribute feedback or bug fixes, you give Beonex GmbH all rights to use them, including to improve the software and to publish your statements as testimonials.

Termination

This EULA agreement is effective from the date you first download or use the Software and shall continue until terminated. You may terminate it at any time upon written notice to Beonex GmbH.

It will also terminate immediately, if you do not pay after the trial period, fail to pay the renewal, request a reimbursement, or fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software, and to delete all your copies. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law and rescue clause

In case of a dispute, private end users may file a complaint at the EU Online Dispute Resolution.

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Germany and settled in courts applicable for Wiesbaden, Germany, as far as permissible by law.

In the event that any part of this agreement is invalid or unenforceable, the terms shall be adapted or modified so that they are enforceable and most closely reflect the original intent of the terms.
